Who we are, and what we collect

AfriUX (Pty) Ltd (“AfriUX”, “we”, “us”) is a private company registered in South Africa under registration number 2025/929510/07. We are a digital product and innovation company working on complex digital services and systems.

This policy explains how we process personal information, and applies to afriux.com and to people who contact us or work with us. It is written to comply with the Protection of Personal Information Act 4 of 2013 (POPIA). Where visitors are located in the European Union or the United Kingdom, we also aim to meet the standards of the GDPR.

Information you give us. When you contact us through our website, by email, or in the course of an engagement, we collect the information you choose to provide. Typically this is your name, email address, and any details you include in your message. We do not ask for identity numbers, financial details or special personal information through this website, and we ask that you do not send them to us unsolicited.

Information collected automatically. When you visit afriux.com, our hosting and analytics tools automatically collect technical information including your IP address, browser type, device type, the pages you view, and the site that referred you. This information is collected through cookies and similar technologies, described below.

Why we process it. We use the information you give us to respond to your enquiry, to provide services you have asked for, to manage a client engagement, and to keep records required by law. We use automatically collected information to understand how the site is used and to improve it. We do not sell personal information, and we do not use it to make automated decisions about you.

Our lawful basis. Under POPIA we process personal information on the basis of your consent, where processing is necessary to conclude or perform a contract with you, or where we have a legitimate interest that does not override your rights, such as understanding how our website is used..

Cookies, analytics, and where your information goes

Cookies. Our website is built on WordPress and Elementor, which set cookies necessary for the site to function and to display pages correctly. We also use cookies for analytics and measurement, described below. Cookies are small files stored on your device. You can block or delete cookies through your browser settings, though some parts of the site may not work as intended if you do.

Google Analytics. We use Google Analytics to understand how visitors use afriux.com: which pages are viewed, how long people stay, and how they arrived. Google Analytics collects your IP address, device and browser information, and your activity on the site, and processes this on servers operated by Google, which are located outside South Africa. Google acts as an operator (processor) on our behalf. You can opt out of Google Analytics using Google’s browser opt-out add-on.

Meta Pixel. We use the Meta Pixel, provided by Meta Platforms, to measure the effectiveness of our marketing and to understand actions taken on our site. The Meta Pixel collects your IP address, browser and device information, and your activity on the site, and may link this to a Meta account if you have one. Meta processes this information on servers outside South Africa. You can manage how Meta uses your information through your Meta account settings and through your browser.

Where our website is hosted, and cross-border transfer. We want to be direct about this. Our website is hosted on servers located in the United States (Utah). This means that when you visit afriux.com, submit a form, or send us a message through the site, your personal information is transferred to and stored in the United States. Google and Meta likewise process information outside South Africa.

Section 72 of POPIA permits the transfer of personal information outside the Republic where the data subject consents to the transfer, where the transfer is necessary for the performance of a contract, or where the recipient is subject to laws or binding agreements that provide an adequate level of protection. By using this website and submitting information to us, you consent to this transfer. If you would prefer that your information is not transferred outside South Africa, please do not submit it through this website; contact us directly at privacy@afriux.com and we will discuss an alternative.

Other parties. We share personal information only with service providers who help us operate, such as our hosting provider and email provider, and only to the extent needed. We may also disclose information where the law requires it. We are not responsible for the privacy practices of websites we link to.

How we keep it, and for how long

Security. We take reasonable technical and organisational measures to protect personal information against loss, unauthorised access and misuse, as required by section 19 of POPIA. These include access controls on our systems, encrypted connections to our website, and limiting access to information to those who need it. No system is perfectly secure, and we cannot guarantee absolute security, but if a security compromise affects your personal information we will notify you and the Information Regulator as section 22 of POPIA requires.

Retention. We keep personal information only for as long as we need it. Enquiries that do not lead to an engagement are kept for up to twelve months and then deleted. Records relating to client engagements are kept for as long as the engagement continues, and afterwards for the period required by South African law, which for financial and company records is generally five years. Analytics information is retained according to the settings of the tools described above.

Children. Our website and services are directed at businesses and organisations, not at children. We do not knowingly collect personal information from anyone under 18. If you believe we have, contact us and we will delete it.

Your rights, and how to reach us

Your rights under POPIA. You have the right to be told what personal information we hold about you and to request a copy of it. You have the right to ask us to correct or delete information that is inaccurate, irrelevant, excessive, out of date, incomplete, misleading or obtained unlawfully. You have the right to object to our processing of your information on reasonable grounds, and to object to its use for direct marketing. Where we rely on your consent, you have the right to withdraw that consent at any time, though this does not affect processing that has already taken place. You also have the right to complain to the Information Regulator.

Where the GDPR applies to you, you additionally have rights of access, rectification, erasure, restriction of processing, data portability, and objection.

Making a request. To exercise any of these rights, contact our Information Officer at privacy@afriux.com. We will respond as soon as we reasonably can, and in any event within the periods set by POPIA. We may need to verify your identity before acting on a request. There is no charge for a reasonable request; where a request is excessive or repetitive we may charge a fee permitted by the Regulations.
